Coal Wage Theft?

 You Could Be Underpaid

There has been an error, please refresh the page.

Based on the information you provided your claim for 2022-2023 could be worth approximately the number listed above. Please note this is an estimation and that a more granular approach will be needed before a final figure is reached.

 What Happens Next? Read On.

 First

A major report announced in the Australian Parliament found that:

  • Casual coal miners working through labour hire firms have been paid way less than they should have been paid under the Black Coal Industry Award.
  • On 2023 assessed wages the theft averages around $32,000 per worker each year. The theft happens because labour hire firms have created enterprise agreements that pay less than what should be paid under the award. Incredibly
    • The CFMEU/MEU is party to the agreements
    • The Fair Work Commission has authorised the agreements.

The full report is here. Read it for yourself.

In May 2024, the Australian Senate passed a motion that requires the Government to investigate underpayments and to "facilitate reimbursement". See further details here.

You deserve justice.

  • You won’t get it from the CFMEU/MEU
  • You won’t get it from the Fair Work Commission
  • You won’t get it from the labour hire firms

The opportunity of wage justice for YOU is now real. But you must act to have your underpayment documented. Don't miss out.

What we will do for you:

Step One

  • We will supply you a simple form for you to provide us information on your coal work and income over the last 5 financial years.
  • With this information we will provide you a confidential statement showing how much you are likely to have been underpaid in each year.
  • With your approval we will lodge your statement as a claim with the Fair Work Ombudsman effectively registering your claim.

Step Two

  • We will supply you with a complete form for you to provide more detailed information about your coal work over the last 5 years.
  • With this information and your approval, we will send this to the Fair Work Ombudsman to assist them in formally assessing your debts.
  • We will (with your approval) monitor the Fair Work Ombudsman in their assessment of your claim, check their calculations, dispute their calculations where necessary and provide you reports on the progress of your claim.
  • Conduct campaigns to support you and your fellow coal miners to achieve justice and reimbursement for the wages you are entitled to.

Cost: You will need to become a member of the IWUA at $875. The CFMEU/MEU charges $2,034 for yearly membership.

 Second

Some basic information of the report made to the Australian Parliament

The report reveals and claims:

  • the detail of how the scheme was created and continues.
  • that the CFMEU/MEU was and is heavily involved.
  • the CFMEU/MEU negotiated, approved or was/is a party to the offending enterprise agreements.
  • that the CFMEU/MEU has a history of major commercial interests in coal mines, labour hire companies, coal transport and loading facilities and more.
  • that the CFMEU/MEU are a business disguised as a union.
  • that the CFMEU/MEU are bosses pretending to be workers.

So, we say that the CFMEU/MEU is not serious about looking after your interests?

The report reveals:

  • that the Fair Work Commission agreed to and signed off on the enterprise agreements at the centre of the scheme.
  • that the Fair Work Commission is not doing its job to protect Australian workers from underpayment.

Can you trust the Fair Work Commission to look after your interests? We say No!

In the Australian Senate:

  • The report was disclosed to all Senators
  • The Fair Work Commission and the Fair Work Ombudsman were grilled about what was referred to as coal wage theft.
  • The Fair Work Ombudsman made an open offer to all people to seek assistance from the FWO.
  • In May 2024, the Australian Senate passed a motion that requires the Government to investigate underpayments and to "facilitate reimbursement". See details here.

It is important that you lodge your likely claim for compensation with the government inquiry and the Fair Work Ombudsman. This is a first and necessary step on your road to compensation.

The coal miners wage report says that on average each coal miner has been underpaid by an average of around $32,000 a year. That means that over 5 years you could be owed somewhere around $150,000.

How much could you actually be owed? It’s worth at least finding out.

Fill out the form below.

We will do an assessment and give you a confidential report.

With your approval, we will lodge your request for investigation with the Fair Work Ombudsman.

*We will chase the Fair Work Ombudsman to get them to do their job.
